Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Caprese ("Service"), operated by Wavefield LLC ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

Description of Service

Caprese is a feedback collection platform for coded prototypes. The Service allows users to collect comments, screenshots, and video recordings from reviewers, and provides AI-powered tools to synthesize and act on feedback.

Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activity under your account

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission.

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload or share content that is harmful, offensive, or infringes on others' rights
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service to send spam or unsolicited communications
• Scrape, crawl, or use automated means to access the Service without permission
• Reverse engineer or attempt to extract the source code of the Service
• Use the Service in a way that violates others' privacy

User Content

You retain ownership of content you submit to the Service ("User Content"), including project URLs, comments, screenshots, and recordings. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content to provide the Service.

You represent that you have the right to submit all User Content and that it does not violate any third party's rights.

Reviewer Feedback

When you share a project link with reviewers, they may submit feedback without creating an account. You are responsible for how you share project links and who has access to provide feedback. We are not responsible for the content of feedback submitted by reviewers.

AI Features

The Service includes AI-powered features such as feedback summaries and Fix Prompts. These features are provided "as is" and may not always be accurate or complete. You are responsible for reviewing and verifying AI-generated content before acting on it.

Pricing and Payment

Some features of the Service require a paid subscription. Prices are displayed on our website and may change with notice. Subscriptions renew automatically unless cancelled. Refunds are provided at our discretion.

If your payment fails, we may suspend access to paid features until payment is resolved.

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Wavefield LLC and are protected by copyright, trademark, and other laws. Our trademarks may not be used without prior written consent.

Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVEFIELD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Wavefield LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
